This Terms and Conditions Agreement (“Agreement”) is effective as of today’s date (the “Effective Date”), by and between Complianceelite (“Provider”), and you (“Customer”). This Agreement governs the use of Complianceelite’s email verification services (“Services”) to ensure responsible, compliant, and effective use.

By accessing or using our Services, you accept and agree to comply with these Terms, all applicable laws, including data protection laws such as GDPR and email marketing regulations under the CAN-SPAM Act, and relevant email standards established in the RFC protocols.

1. Definitions.

“Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control of a Party.

“Agreement” refers to these Terms and Conditions of Use.

2. Services Provided.

Complianceelite provides email verification and data hygiene solutions intended to improve the accuracy and quality of email lists for lawful email marketing and communication purposes. The Customer acknowledges that these Services are intended solely for responsible and ethical use in compliance with RFC protocols governing email formats and handling (e.g., RFC 5321 and RFC 5322).

3. Compliance Obligations.

The Customer agrees to use the Services in accordance with all applicable laws, such as GDPR and CAN-SPAM, as well as email standards defined in RFC protocols. The Customer affirms that email addresses submitted for verification meet RFC standards, and that they have obtained necessary consent where legally required.

4. Data Security & Privacy.

Complianceelite prioritizes the confidentiality and security of customer data. We use industry-standard security measures and maintain GDPR compliance to protect data during verification. For full data protection practices, please refer to our Privacy Policy.

5. RFC Compliance and Limitations.

Complianceelite adheres to standard email formatting and validation protocols, such as RFC 5321 for Simple Mail Transfer Protocol (SMTP) and RFC 5322 for email message format. The Customer is responsible for ensuring submitted emails are formatted according to these standards. Complianceelite disclaims responsibility for validation inaccuracies arising from non-compliance with RFC protocols by the Customer.

6. Service Availability & Maintenance.

Complianceelite strives to provide reliable access to the Services but may perform routine maintenance or updates, which could impact availability. Complianceelite is not liable for interruptions due to maintenance, force majeure, or third-party service issues.

7. Disclaimer of Warranties.

Complianceelite provides its Services "as is" and disclaims all warranties. We do not guarantee specific deliverability rates or results, and disclaim liability for reliance on the verification results provided through our Services.

8. Limitation of Liability.

To the maximum extent permitted by law, Complianceelite’s liability is limited to the amount paid by the Customer for Services in the three months preceding any claim. Complianceelite is not liable for indirect, incidental, or consequential damages arising from the use of the Services.

9. Prohibited Use.

Customers are prohibited from using Complianceelite’s Services for unethical email marketing, including unsolicited messages or spam. Complianceelite reserves the right to suspend or terminate access if misuse is detected.

10. Indemnification.

The Customer agrees to indemnify and hold harmless Complianceelite from any claims or liabilities arising from the misuse of Services or breach of this Agreement, including non-compliance with applicable laws or RFC protocols.

11. Modifications to Terms.

Complianceelite reserves the right to modify these Terms to reflect changes in Services or legal requirements. Significant changes will be posted on our website, and continued use of the Services constitutes acceptance of the updated Terms.
